- Scope
These General Terms and Conditions apply to all orders placed by consumers (Section 13 of the German Civil Code (BGB)) through our online shop crystallinum & co.

According to Section 19 of the German Value Added Tax Act (UStG), no sales tax is charged (small business regulation).
- Conclusion of Contract
The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order. By submitting the order by clicking on "Buy now," you submit a binding offer to conclude a purchase contract.
The purchase contract is only concluded upon dispatch of the goods or upon receipt of the shipping confirmation.
- Prices and Shipping Costs
All prices quoted are final prices within the meaning of the small business regulation according to Section 19 of the German Value Added Tax Act (UStG) – VAT is not shown. Shipping costs are additional and will be displayed during the ordering process.
- Delivery and Shipping Conditions
Live plants are shipped exclusively on Mondays and Tuesdays to avoid unnecessary delays. Shipping is possible within Germany and to EU countries.
Delivery delays due to holidays, weather, or other unforeseen circumstances are possible. Shipping will be made to the address provided by the customer. The buyer is liable for any incorrect information.
- Condition of Plants and Complaints
We guarantee that our plants leave our warehouse in perfect condition. However, stress may occur during transport - this does not constitute grounds for a refund.
Complaints:
- Must be reported by email within 24 hours of delivery.
- Require an unboxing video and relevant photos.
- Damage caused by improper care, late pickup, or delays by the shipping service provider is excluded from refunds.
We handle complaints individually and always strive to find a fair and satisfactory solution.
- No Right of Cancellation or Exchange for Plants
Since these are living plants, exchanges or returns are excluded.
- Payment
Payment is made using the payment methods offered in the shop. The charge is made immediately upon completion of the order process.
- Retention of Title
The goods remain the property of crystallinum & co. until full payment has been made.
- Warranty and Liability
The statutory warranty period of two years applies. No liability is assumed for living plants for:
– Transport damage
– Improper care after receipt
– Natural changes, e.g.:
- Greening or loss of variegation
- Color changes
- Adaptive reactions to changes in light, temperature, or humidity conditions
- Characteristic growth changes
These characteristics are natural and do not constitute a defect in the legal sense.
- Limitation of Liability
We are liable without limitation in cases of intent and gross negligence. In cases of simple negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable, typical damage. Liability under the Product Liability Act remains unaffected.
- Final Provisions
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
